Conditions of Contract and Other Important Notices
This notice cannot be used as a basis for a claim for compensation, nor to interpret the provisions of the Regulation or the Montreal Convention or the Warsaw Convention, and it does not form part of the contract between the carrier and you. No representation is made by the carrier as to the accuracy of the contents of this notice.
Passengers on a journey involving an ultimate destination or a stop in a country other than the country of departure are advised that international treaties known as the Montreal convention, or its predecessor, the Warsaw convention, including its amendments (the Warsaw convention system), may apply to the entire journey, including any portion thereof within a country. For such passengers, the applicable treaty, including special contracts of carriage embodied in any applicable tariffs, governs and may limit the liability of the carrier.
EC Regulation No. 889/2002 requires European Community carriers to apply the provisions of the Montreal Convention limits to all carriage by them of passengers and their baggage by air. Many non-European Community carriers have elected to do so in respect of the carriage of passengers and their baggage.
Where the Montreal Convention applies, the limits of liability are as follows:
Compensation in the case of death or injury
There are no financial limits to the liability for passenger injury or death. For damages up to 113,100 SDRs (please refer to SDR interest rate from www.imf.org) the air carrier cannot contest claims for compensation. Above that amount, the air carrier can defend itself against a claim by proving that it was not negligent or otherwise at fault.
Passenger delays
In case of passenger delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for passenger delay is limited to 4,694 SDRs (please refer to SDR interest rate from www.imf.org).
Baggage delays
In case of baggage delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures. The liability for baggage delay is limited to 1,131 SDRs (please refer to SDR interest rate from www.imf.org).
Destruction, loss or damage to baggage
The air carrier is liable for destruction, loss or damage to baggage up to 1,131 SDRs (please refer to SDR interest rate from www.imf.org). In the case of checked baggage, it is liable even if not at fault, unless the baggage was defective. In the case of unchecked baggage, the carrier is liable only if at fault.
Limited Release Baggage Tag (LRT)
We accept fragile, perishable, and inadequately-packed baggage upon completion of a Limited Release Baggage tag. Baggage with pre-existing damage shall likewise be accepted as a Limited Release Baggage.
The Limited Release Baggage Tag releases the airline from liabilities on baggage resulting from any pre-existing damage or unsuitability for transport.
Higher limits for baggage
A passenger can benefit from a higher liability limit by making a special declaration at the latest at check-in and by paying a supplementary fee.
Where the Warsaw Convention system applies, the following limits of liability may apply:
Compensation in the case of death or injury
16,600 SDRs (please refer to SDR interest rate from www.imf.org) in respect of death or bodily injury if the Hague Protocol to the Convention applies, or 8,300 SDRs (please refer to SDR interest rate from www.imf.org) if only the Warsaw Convention applies. Many carriers have voluntarily waived these limits in their entirety, and US regulations require that, for journeys to, from or with an agreed stopping place in the US, the limit may not be less than US $75,000.
Passenger delays
In case of passenger delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures.
Baggage delays
In case of baggage delay, the air carrier is liable for damage unless it took all reasonable measures to avoid the damage or it was impossible to take such measures.
Destruction, loss or damage to baggage
US $20 for international services or THB500 for domestic services per kg for loss of or damage to checked baggage, and in case of damage to unchecked baggage shall be limited to US $400 per passenger.
Limited Release Baggage Tag (LRT)
